Unless otherwise indicated, the website, including all source code, databases, designs, audio, video, text, photographs, and graphics, as well as the proprietary magic secrets, tutorial videos, and course syllabi, are owned or controlled by us and are protected by copyright and trademark laws. You are granted a limited license to view course materials for personal, non-commercial educational purposes only.

4. User Accounts & Registration

You may be required to register an account to access certain areas of our website, including digital magic lessons. You agree to keep your password confidential and will be responsible for all use of your account. We reserve the right to remove or reclaim usernames that are inappropriate or violate third-party rights.

5. Digital Course Enrollment

When you enroll in any digital course (e.g., Magic for Beginners, Classic Silk Manipulation), you receive a personal, non-transferable, revocable license to access the educational video lessons. You may not download, record, re-upload, distribute, or resell any part of our course materials or teach our proprietary sleight of hand methods for commercial gain without written consent.

6. Shop Purchases & Orders

We offer magic props, cards, wands, books, and starter kits through our online shop. When you submit an order request through our checkout form, it represents an offer to purchase. We reserve the right to refuse or cancel any order request due to product unavailability, errors in pricing, or suspected fraud.

7. Pricing & Billing

Prices for courses and products are displayed in US Dollars (USD) or Australian Dollars (AUD) as indicated on the website. We reserve the right to adjust prices at any time. Strikethrough pricing represents a temporary discount. You agree to provide accurate and complete billing information for all purchases.

8. Shipping & Delivery

Physical magic props are shipped from our warehouses in Australia, the US, or Europe, depending on stock availability. Shipping times and fees are calculated at checkout. We are not liable for customs delays, international import taxes, or shipping carrier failures once the parcel has left our facility.

9. Refund Policy

Our refund policy applies as follows:

  • Digital Courses: Due to the instant delivery of proprietary magic secrets and video content, digital course enrollments are non-refundable once accessed.
  • Physical Goods: Unopened and unused magic decks, wands, and kits can be returned within 14 days of receipt for a refund or exchange, minus shipping costs.

10. Prohibited Activities

You may not use our website or services for any purpose other than that for which we make them available. Prohibited activities include:

  • Sharing magic secrets, tutorial links, or account access with non-registered users.
  • Attempting to bypass security systems, decrypt video streams, or scrape product listings.

Magic is a performing art requiring practice; we do not warrant that enrolling in our academy will guarantee performance bookings, financial success, or specific stage skills. Results vary based on individual dedication.

13. Limitation of Liability

In no event will CardCraft Academy Ltd or our directors, employees, or instructors be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, or punitive damages arising from your use of the website, physical props, or digital tutorials, even if we have been advised of the possibility of such damages.

14. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, partners, and employees, from and against any loss, damage, liability, claim, or demand made by any third party due to or arising out of your breach of these Terms and Conditions or your misuse of our services.

15. Governing Law & Jurisdiction

These Terms and Conditions and your use of our website and services are governed by and construed in accordance with the laws of the State of New South Wales, Australia. Any legal action or dispute arising from this agreement shall be brought exclusively in the courts of Sydney, Australia.

If any provision or part of a provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and Conditions and does not affect the validity and enforceability of any remaining provisions.
